1. Medical Disclaimer & Health Warning

IMPORTANT: UNSWEET IS A WELLNESS TOOL, NOT A MEDICAL DEVICE.

1.1 No Medical Advice

The App provides tools for tracking sugar intake, building habits, and general wellness gamification. The content, data, and insights provided by the App are for informational and recreational purposes only. They do not constitute medical advice, diagnosis, or treatment.

1.2 Consult Your Doctor

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, diet changes, or weight loss. Never disregard professional medical advice or delay in seeking it because of something you have read on the App.

1.3 Risk Factors

If you suffer from conditions such as diabetes, hypoglycemia, eating disorders, or if you are pregnant or nursing, you are specifically advised not to use this App without strict medical supervision.

1.4 Release of Liability

You acknowledge that your use of the App is at your own risk. Unsweet shall not be held liable for any physical or mental injury, health complications, or other damages that may result, directly or indirectly, from your use of the App.

2. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract. If you are under 18, you are prohibited from using the App.

3. User Accounts

3.1 Account Creation

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Security

You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

4.1 Apple In-App Purchases

All financial transactions for the iOS version of the App are handled directly by Apple Inc. via the Apple App Store ("In-App Purchases").

4.2 Billing & Processing

We do not process, store, or have access to your full credit card information or billing details. Apple processes these details securely. We only receive technical tokens (e.g., subscription status, expiration date) to grant you access to premium features.

4.3 Auto-Renewal

Subscriptions purchased via the Apple App Store will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellations & Refunds

You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase. All refund requests must be directed to Apple Support. As the developer, we do not have the ability to process refunds directly for Apple In-App Purchases, and such refunds are subject to Apple's Media Services Terms and Conditions.

4.5 Changes to Pricing

We reserve the right to change our subscription plans or adjust pricing for our service in any manner and at any time as we may determine in our sole and absolute discretion.

5. Intellectual Property

The App and its original content, features, and functionality (including but not limited to all code, design, text, graphics, and user interface) are and will remain the exclusive property of Netanel Hadad. The App is protected by copyright, trademark, and other laws of both Israel and foreign countries.

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any local, state, national, or international law.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App.
• Harass, abuse, or harm another person via the App.
• Use any automated system (robots, spiders) to access the App.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

7.1 No Indirect Damages

IN NO EVENT SHALL UNSWEET, ITS OPERATOR, AFFILIATES, AGENTS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

7.2 Cap on Liability

IN NO EVENT SHALL UNSWEET'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO UNSWEET FOR THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

8. Indemnification

You agree to defend, indemnify, and hold harmless Unsweet and Netanel Hadad from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the App; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts located in the State of Israel, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
